Monk Mindset Privacy Policy

To ensure transparency and give you more control over your Personal Data, this privacy policy (“Privacy Policy”) describes how we, Monk Works, LLC, and our subsidiaries and affiliates (together, “Monk Mindset”, “we”, “our” or “us”) process, use, collect and store Personal Data (defined below) that we receive from or about you (“you”) in different scenarios.

For instance, when you browse or visit our website (“Website”), create an account and log in to our Monk Mindset application (the “App”, and together with the Website, the “Services”).

Please read this Privacy Policy carefully, so you can fully understand our practices in relation to Personal Data. Important note: Nothing in this Privacy Policy is intended to limit in any way your statutory right, including your rights to a remedy or means of enforcement.

“Personal Data” means any information that can be used, alone or together with other data, to uniquely identify any living human being and any information deemed as personally identifiable information by applicable privacy laws.

We may update this Privacy Policy from time to time; therefore we ask you to check back periodically for the latest version. If we implement any significant changes to the use of your Personal Data in a manner materially different from that stated at the time of collection, we will notify you by posting a notice on our Website or by changing the “Last Updated” date above.

Any capitalized but undefined term in this Privacy Policy shall have the meaning given to it in the Terms of Use [HYPERLINK].

  1. What Information we Collect, Why we Collect it, and How it is Used

We collect and use the following information:

When you use our Website: 

Personal Data we may collect: We use analytics tools and log files on our Website which may collect Personal Data such as IP address, pages clicked, search and browser history, and device information (“Usage Data”). If you take our survey, we will collect information about your habits, religion, personal philosophy, age, gender, marital status, email and contact data, and name (“Survey Data”). If you choose to purchase a course from our Services, we will collect payment information via a third party payment processor.

Cookies. When a user visits the Website, we place cookies, trackers, web beacons, or similar files (collectively, “Cookies”) to assign a unique identifier to the applicable user’s computer or other device. A Cookie is a piece of data stored on your hard drive containing personal information about you. We use Cookies to improve the quality of the Website and our Services, including for storing user preferences and tracking Website-user trends (such as pages opened and length of stay at the Website). Most internet browsers are initially set up to accept Cookies, but you can reset your browser to refuse all Cookies or to indicate when a Cookie is being sent. To disable and reject advertising and other non-necessary Cookies, follow the instructions in Section 7 or on our cookie banner. You can opt out of Google’s collection and processing of data generated by your use of the Services by visiting https://tools.google.com/dlpage/gaoptout. Even in the case where a user rejects a Cookie, they may still use the Website; provided, however, that certain functions of the Website may be impaired or rendered inoperable if the use of Cookies is disabled.

  1. For what purposes: We use Usage Data to analyze use trends of the Website and maintain and improve the functionality of the Services; we may also share certain of this information with third party service providers like hosting, analytics, and possible advertisers. We use Survey Data, with your consent, to provide a custom assessment to you in the Services. 

  2. Consequences of not providing the Personal Data: Certain Website features may not be available. Providing Survey Data is not mandatory, but if you do not provide Survey Data, we will not be able to provide a survey output for you. If you do not provide valid payment information.

When you sign up for and use our App:

  1. Personal Data we may collect: Full name, email, payment information, information about your habits and schedule, intentions for using the App, desired outcomes, information about your Screen Time (with your consent), data about your engagement with the App such as pages opened or features used, calendar information, sleep information, and any other Personal Data that you choose to provide us or request that we track. With respect to our app-blocking feature, Personal Data collected includes whether specific apps are successfully blocked according to your set schedule, the duration of activated blocking sessions, and adherence to your self-imposed focus periods (“App Blocking Data”). Finally, we use your Personal Data submitted through the App to create inferences we believe will help with your stated goals, such as certain content or actions we think may fulfill your stated purposes (“Inferences”). 

  2. For what purposes: To provide the Services you request through the App, and other requests for ongoing customer assistance, technical support and maintenance of the Website and your App account; to better understand your needs, both on an aggregated and individualized basis, in order to further develop, customize and improve our Services based on users’ preferences, experiences and difficulties; to communicate with you and contact you to obtain feedback from you regarding the Services; creating and managing your account or other user profiles; processing orders or other transactions; billing; providing you with the products, Services or information you request; improving the Services, including testing, research, internal analytics and product development; doing fraud protection, security and debugging; and carrying out other business purposes stated when collecting your Personal Data. With respect to App Blocking Data, this data is collected to provide you with insights into your focus habits and to help you track your progress in minimizing distractions. We do not track the content within the apps you use, only their operational status (blocked or unblocked). We do not monetize or otherwise sell Inferences to any third party.

  3. Consequences of not providing the Personal Data: You have control over the amount of Personal Data provided to the App. Certain features require access to more Personal Data; for example, if you want to block certain applications on your device, we need App Blocking Data. If you want to track screen time, we need access to your phone’s Screen Time. If you do not provide certain Personal Data to the App, we may not be able to provide you with certain Services. 

When you contact us (e.g. via our customer support, submit a request or similar forms):

  1. Personal Data we may collect: Name, email address, telephone number, messages/comments, as well as recording and any other Personal Data that you decide to provide us.

  2. For what purposes: To process and answer questions and to contact you upon your request; to provide support and related communications; to customize your experience.

  3. Consequences of not providing the Personal Data: We will not be able to: process and answer questions and to contact you upon your request; provide support and related communications; customize your experience.

Finally, please note that some of the abovementioned Personal Data will be used for detecting, taking steps to prevent, and prosecution of fraud or other illegal activity, to identify and repair errors, to conduct audits, and for security purposes. Personal Data may also be used to comply with applicable laws and regulations, with investigations performed by the relevant authorities, law enforcement purposes, and/or to exercise or defend legal claims. If Monk Mindset undergoes a corporate transaction, Personal Data may be transferred to the surviving entity. In certain cases, we may anonymize, aggregate or de-identify your Personal Data. “Anonymous Information” means information which does not enable identification of an individual user, such as aggregated information about the use of our Services. We may use Anonymous Information and/or disclose it to third parties for our business purposes and further use such anonymized data for internal business purposes, including, without limitation, to improve, enhance and optimize our Services and for research and development purposes.

2. Your Obligations

You are responsible for the integrity and authorized usage of Personal Data you provide to the Services. Monk Mindset will make no investigation as to the veracity of the Personal Data you submit to the Services. By providing the Personal Data to us, you represent and warrant that your Personal Data is accurate and up to date; Monk Mindset will have no responsibility with respect to Personal Data submitted to us or the outputs of the Services. You acknowledge that participation in the Services and the App is completely voluntary.

3. How We Protect Your Personal Data

We have implemented appropriate technical, organizational and security measures designed to protect your Personal Data. However, please note that we cannot guarantee that the information will not be compromised as a result of unauthorized penetration of our or our partners’ systems. As the security of information depends in part on the security of the computer, device or network you use to communicate with us and the security you use to protect your account and Personal Data, please make sure to take appropriate measures to protect this information.

4. How We Retain Your Personal Data

We store your Personal Data for as long as such Personal Data is necessary in accordance with the purpose for which we collected it, and as long as necessary to fulfill your requests or inquiries or provide services or until we proactively delete it or you send a valid deletion request. In certain circumstances we may store your Personal Data for longer periods of time, for example (i) where we are required to do so in accordance with legal, regulatory, tax or accounting requirements, or (ii) for us to have an accurate record of your dealings with us in the event of any complaints or challenges, or (iii) if we reasonably believe there is a prospect of litigation relating to your Personal Data or dealings. We maintain a data retention policy which we apply to Personal Data in our care. 

5. With Whom We Share Your Personal Data

In addition to the descriptions from Section 1, we may share your Personal Data with the following categories of third parties. In the past 12 months, we have not sold, nor do we sell any Personal Data or share Personal Data for targeted advertising, as each of those terms are defined by the California Consumer Privacy Act.

  • Vendors, Partners and Affiliates. Monk Mindset uses certain selected third parties to help us provide, improve, enhance, protect, and promote our Services. From time to time, we may need to share your Personal Data with these parties. These include service providers of the following services: hosting/storage, email distribution and monitoring, authentication, logging and monitoring, data enrichment, analytics and business intelligence, data and cyber security services, billing and payment processing services, fraud detection and prevention services, risk management, session recording and remote access services, our legal and financial advisors, and document management vendors. Depending on the context, we may share the following categories of Personal Data with such third-party service providers for business purposes: identifiers, including name, alias, unique personal identifiers, online identifiers, IP addresses, business email addresses, or other similar identifiers, as well as information regarding services purchased, obtained, or considered.

  • Third parties.  We allow you to share your Personal Data with Third Party Services as requested or directed by you through the Services (e.g. sharing contact information with  a course provider or a payment processor). 

Please remember that such Third Party Services’ use of your Personal Data will be governed by their privacy policies and terms and we are not responsible for their acts or omissions. We strongly recommend you review their privacy policy and terms and conditions before sharing any data (including, personal data or confidential information) with any such Third Party Services.

  • Law enforcement, legal requests and duties. To the extent necessary and subject to applicable law, Monk Mindset may disclose or otherwise allow access to any categories of Personal Data described in this Privacy Policy, with or without notice to you, to regulators, courts or competent authorities, pursuant to valid legal requests (such as a subpoenas, legal proceedings, search warrants or court orders), to comply with applicable laws, regulations and rules (including, without limitation, federal, state or local laws), and requests of law enforcement, regulatory and other governmental agencies or if required to do so by court order.

  • In connection with a change in corporate control. Should Monk Mindset or any of its affiliates undergo any change of control, including by means of merger, acquisition or purchase of substantially all its assets or equity, or in the event of bankruptcy or a comparable event, your Personal Data (to the minimum extent required) may be shared with the parties involved in such event.

6. Data Storage, Transfers, and Our Legitimate Interest in Processing Your Data

Your Personal Data is stored in data centers of our cloud-hosting third-party service providers that are in the United States. By submitting Personal Data through the Services, you consent to the transfer and storage of your Personal Data in and to the United States. If you do not consent to this transfer, you may not use the Services. 

We transfer Personal Data to provide Services you explicitly request from us and pursuant to our legitimate interests, which include:

  • Perform the Services that you have requested;

  • Pursue our legitimate interests to:

    • understand who our customers and potential customers are and their interests in our products and Services,

    • manage our relationship with you and other customers,

    • provide you with marketing materials,

    • perform research (including marketing research),

    • carry out core business operations such as accounting and filing taxes, and

    • help detect, prevent, or investigate security incidents, fraud, and other abuse and/or misuse of our products and Services;

  • Comply with any legal obligations we may have; and

  • Carry out other uses to which you have consented.

7. Your Privacy Rights; How to Delete Your Account

Rights: The following rights (which may be subject to certain exemptions or derogations) shall apply to certain individuals:

  • You have a right to access Personal Data held about you. Your right of access may normally be exercised free of charge; however, we reserve the right to charge an appropriate administrative fee where permitted by applicable law;

  • You have the right to update relevant information in your account;

  • You have the right to request the erasure/deletion of your Personal Data (e.g. from our records). Please note that there may be circumstances in which we are required to retain your Personal Data, for example for the establishment, exercise or defense of legal claims, or to retain records of taxes or fees paid pursuant to our legal obligations;

  • You have the right to object, to or to request restriction, of our processing of your sensitive Personal Data, as defined by applicable law;

  • You may have certain additional rights under local privacy laws applicable in your jurisdiction. To the extent such privacy laws apply to you and us, we will respect your rights and comply with such laws.

  • You can exercise the above rights by contacting us at monk@monkmindset.com. Subject to legal and other considerations, we will make every reasonable effort to honor your request within 30 days in accordance with applicable law or inform you if we require further information to fulfil your request. When processing your request, we may ask you for additional information to confirm or verify your identity and for security purposes before processing and/or honoring your request. We reserve the right to charge a fee where permitted by law, for instance, if your request is manifestly unfounded or excessive. If your request would adversely affect the rights and freedoms of others (for example, would impact the duty of confidentiality we owe to others) or if we are legally entitled to deal with your request in a different way than initially requested, we will address your request to the maximum extent possible, all in accordance with applicable law.

  • Deleting your account: Should you decide to delete your account, you may do so by emailing monk@monkmindset.com. If you terminate your account, any association between your account and Personal Data we store will no longer be accessible through your account. We will retain some information about you and your payments as set forth above. 

8. Use by Children

Monk Mindset does not offer its products or services for use by children and, therefore does not knowingly collect personal information from minors who are under the age of 13 through the Services. If a parent or guardian becomes aware that his or her child has provided us with personally identifiable information without his/her consent, then he or she should contact Monk Mindset as described below. If we become aware that a child under the age of 13 has provided us with personally identifiable information, please contact us at monk@monkmindset.com so we will delete such information.

 

9. Links to and Interaction with Third Party Services

Our Website and/or Services may enable you to interact with or contain links to your third-party accounts and other third-party websites, mobile software applications and products or services that are not owned or controlled by us (each a “Third Party Service”). We are not responsible for the privacy practices or the content of such Third Party Services. Please be aware that Third Party Services may collect Personal Data from you. Accordingly, we encourage you to read the terms and conditions and privacy policies of each Third Party Service that you choose to use or interact with.

  

10. Communication from Monk Mindset

Monk Mindset may contact you with important information regarding our Services, or your use thereof. For example, we may send you a notice (through any of the means available to us) if a certain Service is suspended for maintenance; reply to your support ticket or e-mail; send you reminders or warnings regarding upcoming or late payments for your current or upcoming subscriptions; or notify you of material changes in our Services.

It is important that you are always able to receive such messages. For this reason, you cannot opt-out of receiving such Service and billing messages unless you are no longer our user (which can be done by deleting your account).
